Arizona wine shipment restriction wins court battle

Arizona's law regulating shipments of wines to consumers won an important battle yesterday. The 9th circuit court of appeals ruled that Arizona's statutory three-tier distribution scheme didn't violate the Constitution. In my opinion, these types of laws should be repealed because they hurt the consumer and competition. Arizona's law provided an exception for wineries that produce less than 20,000 gallons per year and with respect to shipping wine to people in Arizona who actually visited the winery (but those shipments can't exceed two cases).

While it is unclear how many of Arizona's wineries produce more than 20,000 gallons per year, I suspect that most of them do. Small wineries are not the ones worried about shipping to other states - they have enough to worry about in their local markets. These types of laws are generally designed to protect local wine producers, which is exactly the problem. This might be a good thing for Arizona wineries, but overall, the wine industry suffers when every state tries to protect its own wineries.

When all is said and done, the wine consumer is the one that is hurt by these unconstitutional and anti-competitive laws.

We want to thank all the hard work so many have put into making wine, and with all of those that were impacted by the economic downturn the best of luck in 2010.
